Welcome to CM Keepsakes. These Terms of Service (“Terms”) govern your use of our website and the purchase of products and services from CM Keepsakes.
Throughout these Terms, “CM Keepsakes,” “we,” “us,” and “our” refer to CM Keepsakes. “You” and “your” refer to the customer, website visitor, or person using our services.
By accessing our website, placing an order, uploading content, or purchasing a product or service from us, you agree to these Terms.
If you do not agree with these Terms, please do not use our services or place an order.
1. Our Products
CM Keepsakes creates personalized products, including custom photo magnets, using photographs, images, designs, text, logos, and other content submitted by our customers.
Because our products are personalized and made to order, certain conditions regarding cancellations, returns, refunds, and customer-provided content apply.
Product photographs and mockups shown on our website are intended to provide a reasonable representation of our products. Minor differences in colour, appearance, positioning, dimensions, materials, or finish may occur as a normal part of printing and production.
2. Placing an Order
When placing an order, you are responsible for providing complete and accurate information, including your contact information, shipping address, product selections, uploaded content, and personalization details.
Please review your order carefully before submitting it.
After an order has been placed, we may send an order confirmation to the email address provided during checkout. An order confirmation does not necessarily mean that we have accepted or begun production of the order.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or technical errors, unavailable materials, prohibited content, or circumstances that prevent us from reasonably fulfilling the order.
If we cancel an order that has already been paid for and the cancellation is not due to a breach of these Terms by the customer, we will provide an appropriate refund for the cancelled portion.
3. Personalized Orders
Our personalized products are manufactured using the content and selections submitted by you.
You are responsible for reviewing your photographs, cropping, positioning, spelling, quantities, and other personalization details before completing your order.
Where our website provides an electronic preview or cropping tool, the preview is intended to help demonstrate how your finished product may appear. Minor differences may occur during production.
Once an order has entered production, changes may no longer be possible.
4. Customer Photos & Content
By uploading photographs, images, artwork, logos, text, or other content (“Customer Content”) to CM Keepsakes, you confirm that you own the content or have the necessary rights, licences, consents, and permissions to submit and reproduce it for the products you are ordering.
You retain ownership of your Customer Content.
By submitting Customer Content, you grant CM Keepsakes a limited permission to access, reproduce, crop, resize, format, process, print, and otherwise use that content only as reasonably necessary to:
- Create your personalized products;
- Process and fulfill your order;
- Perform quality control;
- Provide customer support;
- Produce approved replacements or reprints; and
- Address legitimate order-related issues.
This permission does not transfer ownership of your photographs or other content to CM Keepsakes.
5. Marketing Use of Customer Photos
CM Keepsakes will not use your personal photographs for advertising, social media, product examples, promotional materials, or other marketing purposes without your permission.
If we would like to feature your photographs or finished personalized products in our marketing, we will request permission separately.
Providing permission for marketing use is optional and is not required to purchase our products.
6. Intellectual Property & Customer Responsibility
You must not submit content that you do not have the right or permission to reproduce.
You are responsible for ensuring that Customer Content does not unlawfully infringe another person’s copyright, trademark, privacy, publicity, or other legal rights.
This may include, for example, professionally taken photographs, copyrighted artwork, business logos, characters, graphics, or other protected material that you do not have permission to reproduce.
CM Keepsakes reserves the right to decline, suspend, or cancel an order if we reasonably believe that submitted content may be unlawful, infringing, or otherwise inappropriate for us to reproduce.
7. Unacceptable Content
We reserve the right to refuse to reproduce content that is unlawful or that we reasonably determine we should not produce, including content that promotes or depicts unlawful exploitation or abuse or otherwise violates applicable law.
We may also refuse an order where producing the submitted material could reasonably expose CM Keepsakes or another person to legal liability.
Where appropriate, an order refused before production will be cancelled and any applicable payment will be refunded.
8. Photo Quality
The quality of your finished personalized product depends partly on the quality of the image you provide.
Low-resolution photographs, screenshots, heavily compressed files, blurry photographs, poor lighting, excessive digital zoom, or other characteristics of the original image may affect print quality.
Customers are responsible for reviewing their photographs and previews before submitting an order.
We may contact you if we notice an obvious image-quality issue before production, but we cannot guarantee that every quality issue will be identified.
An issue resulting from the quality or characteristics of a customer-provided image is generally not considered a manufacturing defect.
9. Colour & Screen Differences
Computer monitors, phones, tablets, and other screens display colours and brightness differently from printed products.
As a result, the colours, brightness, contrast, saturation, and appearance of your finished product may vary slightly from what you see on your screen.
Reasonable differences between screen displays and printed products are not considered manufacturing defects.
10. Prices & Payment
All prices displayed on our website are shown in the currency indicated at checkout.
Applicable taxes, shipping charges, and other charges will be displayed or calculated during checkout where applicable.
We reserve the right to change our prices at any time. Price changes will not normally affect orders that have already been accepted and paid for.
If a product is displayed at an obviously incorrect price because of a technical, typographical, or system error, we reserve the right to correct the error and cancel or contact you regarding the affected order.
Payments are processed through Shopify and/or third-party payment providers. CM Keepsakes does not directly control the policies or availability of third-party payment services.
11. Promotions & Discount Codes
From time to time, CM Keepsakes may offer promotional pricing, discount codes, or special offers.
Unless otherwise stated, promotions:
- Cannot be exchanged for cash;
- May be subject to expiry dates or eligibility requirements;
- May not be combined with other offers; and
- May be modified or discontinued where permitted by law.
We reserve the right to cancel or refuse the use of a promotion in cases of misuse, fraud, or technical error.
12. Order Changes & Cancellations
If you need to change or cancel an order, please contact us as soon as possible.
We will make reasonable efforts to accommodate requests made before production begins.
Because personalized products are made specifically for each customer, changes or cancellations may not be possible once an order has entered production.

13. Returns, Refunds & Replacements
Because our personalized products are made to order using customer-provided content, we generally do not accept returns, exchanges, or refunds for change of mind after an order has entered production.
If your order arrives damaged, defective, incorrect due to an error on our part, or otherwise qualifies under our Return & Refund Policy, please contact us within the timeframe specified in that policy.
Depending on the circumstances, we may provide a replacement, reprint, refund, or another appropriate resolution.
Nothing in these Terms or our Return & Refund Policy is intended to limit rights or remedies available to consumers under applicable law.
14. Production Times
Any production or processing times displayed on our website are estimates unless expressly stated otherwise.
Production times may be affected by order volume, equipment issues, supply availability, holidays, unusually large orders, or circumstances outside our reasonable control.
If a significant delay affects your order, we may contact you using the information provided at checkout.
15. Shipping & Delivery
Shipping and delivery estimates are not guarantees unless expressly stated otherwise.
Once an order has been transferred to a shipping carrier, delivery may be affected by weather, carrier delays, service interruptions, incorrect addresses, or other circumstances outside our reasonable control.
Customers are responsible for providing an accurate and complete delivery address.
If an order is returned because of an incorrect or incomplete address supplied by the customer, additional shipping charges may apply before the order is resent.

16. Bulk Orders & Live Events
CM Keepsakes may offer bulk-order pricing, business orders, wedding services, live-event services, and other custom arrangements.
Bulk orders and live-event services may be subject to additional terms provided in a quote, invoice, service agreement, or written correspondence.
These additional terms may include deposits, minimum quantities, payment schedules, production deadlines, cancellation conditions, travel charges, setup requirements, and other event-specific arrangements.
Where specific written terms for a bulk order or event conflict with these general Terms, the specific terms agreed to for that order or event will apply to the extent of the conflict.
17. Third-Party Services
We use third-party services to operate our business and fulfill orders. These may include services for e-commerce, payment processing, photo uploading and processing, cloud storage, shipping, analytics, and other business functions.
For example, customer photographs and order information may be processed using services such as Shopify, NINEMAGS, Dropbox, and related technology providers.
Your use of certain features may also be subject to the terms and privacy practices of those third parties.
Please refer to our Privacy Policy for additional information about how customer information and uploaded content may be processed.
18. Privacy
Your privacy is important to us.
Our collection, use, processing, storage, and handling of personal information and customer-uploaded content are described in our Privacy Policy.
Customer photographs are not used by CM Keepsakes for marketing or promotional purposes without permission.
19. Website Content & CM Keepsakes Intellectual Property
Unless otherwise indicated, the CM Keepsakes name, branding, logo, website design, original graphics, product descriptions, photographs created by us, and other original website content belong to CM Keepsakes or are used with permission.
You may not reproduce, distribute, sell, modify, or commercially exploit our original content without permission, except where permitted by law.
Customer ownership of Customer Content is not affected by this section.
20. Website Availability
We make reasonable efforts to keep our website and ordering system available and functioning properly.
However, we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend or modify portions of the website for maintenance, security, technical problems, updates, or other operational reasons.
21. Limitation of Liability
To the extent permitted by applicable law, CM Keepsakes will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Canadian or Ontario law.
22. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, or reasonable costs arising from Customer Content you submit where such content infringes another person’s rights or where you did not have the necessary permission to reproduce it.
This section does not apply to claims resulting from CM Keepsakes’ own wrongful conduct.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, technology, business practices, or legal requirements.
The most current version will be posted on our website with an updated revision date.
Changes will apply prospectively unless otherwise required by law.
24. Governing Law
These Terms are governed by the applicable laws of the Province of Ontario and the federal laws of Canada applicable therein, without limiting any mandatory consumer protections that may apply to you.
25. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
